സിഎംആര്‍എല്‍– എക്‌സാലോജിക് ദുരൂഹ ഇടപാടിലെ ഇഡി അന്വേഷണത്തില്‍ സ്റ്റേ അനുവദിക്കാനാകില്ലെന്ന് ഹൈക്കോടതി. സ്റ്റേ വേണമെന്ന സിഎംആര്‍എല്ലിന്റെ ആവശ്യം തള്ളി. അതേസമയം, വെള്ളിയാഴ്ച വരെ സിഎംആര്‍എല്ലിനെതിരെ തുടര്‍നടപടികള്‍ പാടില്ല. ഇഡി അന്വേഷണം തടയണമെന്ന സിഎംആര്‍എലിന്‍റെ അപ്പീലില്‍ വെള്ളിയാഴ്ച്ച ഹൈക്കോടതി ഡിവിഷന്‍ ബെഞ്ച് വിധി പറയും. ജസ്റ്റിസുമാരായ രാജാ വിജയരാഘവന്‍, കെ.വി.ജയകുമാര്‍ എന്നിവരുടെ ഡിവിഷന്‍ ബെഞ്ചാണ് വിധി പറയുന്നത്.

അതേസമയം, കേസില്‍ വീണയ്ക്കെതിരായ ഇ.ഡി അന്വേഷണത്തിന് തടസമില്ല. വെള്ളിയാഴ്ച വരെ തുടര്‍നടപടികള്‍ പാടില്ല എന്ന ഉത്തരവ് സി.എം.ആര്‍.എല്ലിന് മാത്രമേ ബാധകമാകൂ.

ഷെഡ്യൂള്‍ഡ് കുറ്റകൃത്യം ഇല്ലാത്തിനാല്‍ പിഎംഎല്‍എ നിയമപ്രകാരം കേസെടുക്കാന്‍ ഇഡിക്ക് അധികാരമില്ലെന്നാണ് സിഎംആര്‍എലിന്റെ പ്രധാന വാദം. സിംഗിള്‍ ബെഞ്ചിന്റെ വിധിയില്‍ പിഴവുണ്ട്. അന്വേഷണ സ്വഭാവത്തിലുള്ള സമന്‍സ് ഇഡി അയച്ചത് നിയമവിരുദ്ധമാണ്. അധികാരമില്ലാത്ത അന്വേഷണമാണ് ഇഡി നടത്തുന്നത് എന്നും സിഎംആര്‍എല്‍ വാദിച്ചു. വാദം കേട്ട സിംഗിള്‍ ബെഞ്ച് വിധിപറയാന്‍ 20മാസം വൈകിപ്പിച്ചു എന്നും വാദമുണ്ട്.

A division bench comprising Justices Raja Vijayaraghavan and K.V. Jayakumar dismissed the appeal filed by CMRL requesting a freeze on the central agency's dynamic actions. CMRL strongly argued that the ED lacks jurisdiction under the PMLA framework since no standalone scheduled or predicate offence has been formally established in the matter. The corporate petitioner also alleged that the previous single-bench verdict contained legal errors and criticized the delayed delivery of the judgment. Despite these contentions, the division bench cleared the path for the statutory probe to continue and scheduled the final detailed arguments for later today.
