സ്ത്രീയുടെ തോളിൽ പിടിച്ച് അമർത്തുന്നതും തള്ളിമാറ്റുന്നതും ലൈംഗികാതിക്രമമായി കണക്കാക്കാനാകില്ലെന്ന് ബോംബെ ഹൈക്കോടതി.  ഇത്തരം പ്രവൃത്തി അവരിൽ നാണക്കേടുണ്ടാക്കുമെന്നതിനാൽ സ്ത്രീത്വത്തെ അപമാനിക്കുന്നതിന് തുല്യമായേക്കാം.  എന്നാൽ അതിൽ ലൈംഗിക ഉദ്ദേശ്യമോ അത്തരം സ്പര്‍ശനമോ ഇടപെടലോ ഇല്ലാത്തതിനാൽ ലൈംഗിക പീഡനമായി കണക്കാക്കാനാകില്ലെന്ന് ഹൈക്കോടതി വ്യക്തമാക്കി.  

ഗിരീഷ് നിഗോണ്ട എന്നയാൾക്കെതിരെ ചുമത്തിയ കേസിലെ ലൈംഗികാതിക്രമ വകുപ്പുകള്‍ കോടതി ഭാഗികമായി റദ്ദാക്കി.  ഗ്രാമപഞ്ചായത്ത് ഓഫീസിൽ അതിക്രമിച്ചുകയറി,  ബ്ലോക്ക് ഡെവലപ്‌മെന്റ് ഓഫീസറുമായി വഴക്കിട്ട് അവരുടെ തോളിൽ പിടിച്ച് തള്ളിമാറ്റി എന്നായിരുന്നു കേസ്. സാക്ഷി മൊഴികൾ പരാതിക്കാരിയുടെ പ്രസ്താവനയെ സാധൂകരിക്കുന്നുണ്ടെങ്കിലും ലൈംഗികാതിക്രമ കുറ്റങ്ങൾ പ്രഥമദൃഷ്ട്യാ നിലനിൽക്കില്ലെന്ന് കോടതി നിരീക്ഷിച്ചു.  

ENGLISH SUMMARY:

The Bombay High Court has ruled that grabbing or pushing a woman's shoulder does not constitute sexual assault under the law. The court noted that while such an act may insult a woman's modesty, it cannot be classified as sexual harassment due to the absence of sexual intent or physical contact of a sexual nature. Consequently, the bench partially quashed the sexual assault charges leveled against an accused individual involved in a dispute at a panchayat office. However, the court maintained that witness testimonies still substantiate other related offenses stemming from the altercation.
