അപകടകാരികളായ തെരുവുനായ്ക്കളെ ദയാവധത്തിന് വിധേയമാക്കാനുള്ള സർക്കാർ തീരുമാനം ഹൈക്കോടതി മരവിപ്പിച്ചു. ദയാവധത്തിന് എതിരെ കോടതി ഉത്തരവുകള്‍ നിലവിലുണ്ടെന്നും എബിസി നിയമം ദയാവധത്തിന് എതിരാണെന്നും ചൂണ്ടിക്കാട്ടിയാണ് ഹൈക്കോടതിയുടെ നടപടി. ഇനിയൊരു ഉത്തരവുണ്ടാകുന്നതു വരെയാണ് ആനിമൽ ഹസ്ബൻഡറി പ്രാക്ടീസസ് ആൻഡ് പ്രൊസീജേർസ് റൂൾസ് സെക്‌ഷൻ 8 (എ) പ്രകാരം പ്രഖ്യാപിച്ച ദയാവധം തടഞ്ഞത്. 

സംസ്ഥാനത്ത് കൂടിവരുന്ന തെരുവുനായ ആക്രമണത്തിന്‍റെ പശ്ചാത്തലത്തിലായിരുന്നു മൃഗങ്ങളെ ദയാവധത്തിന് വിധേയമാക്കാമെനുള്ള തദ്ദേശവകുപ്പുപ്പിന്‍റെ തീരുമാനം. അതേസമയം, തെരുവുനായകളുടെ കടിയേറ്റവർക്കുള്ള നഷ്ടപരിഹാരം നിർണയിക്കാൻ സർക്കാർ മുന്നോട്ടുവച്ച കമ്മിറ്റി കോടതി അംഗീകരിച്ചു. തെരുവുനായകൾ ഉയർത്തുന്ന ഭീഷണി മറികടക്കാന്‍ എബിസി നിയമം ഭേദഗതി ചെയ്യുന്നതിന് കേന്ദ്ര മൃഗസംരക്ഷണ വകുപ്പിനെ സമീപിക്കാൻ തീരുമാനിച്ചിട്ടുണ്ടെന്ന് സർക്കാർ കോടതിയിൽ വ്യക്തമാക്കി.

ENGLISH SUMMARY:

The Kerala High Court has stayed the state government's decision to euthanize aggressive stray dogs. Citing existing court orders and provisions under the ABC (Animal Birth Control) Rules that prohibit mercy killing, the court intervened to halt the plan under Section 8(a) of the Animal Husbandry Practices and Procedures Rules. The euthanasia order was initially proposed by the Local Self Government Department in response to rising dog attacks in the state. However, the court accepted the government’s proposal to form a compensation committee for bite victims. The state also informed that it would approach the central Animal Welfare Board to amend the ABC rules for better control of the stray dog menace.
