കേരള സര്‍വകലാശാല റജിസ്ട്രാറുടെ സസ്പെന്‍ഷന്‍ റദ്ദാക്കിക്കൊണ്ടുള്ള സിന്‍ഡിക്കേറ്റ് തീരുമാനത്തില്‍ വിസി ഒപ്പു വെക്കാത്തിടത്തോളം അതിന് നിയമസാധുത ലഭിക്കില്ല. താല്‍ക്കാലിക വിസി ഡോ.സിസ തോമസോ വിസിയുടെ ചുമതലയുള്ള ഡോ. മോഹനന്‍ കുന്നുമ്മലോ സിന്‍ഡിക്കറ്റ് തീരുമാനത്തിന് അംഗീകാരം നല്‍കില്ല. അതോടെ  റജിസ്ട്രാര്‍ ഡോ. കെ.എസ്.അനില്‍കുമാറിന് വീണ്ടും കോടതിയെ സമീപിക്കേണ്ടിവരും. 

കാവിക്കൊടിയേന്തിയ ഭാരതാംബാ വിവാദത്തില്‍ സസ്പെന്‍ഷനിലായ കേരള സര്‍വകലാശാല റജിസ്ട്രാര്‍ ഡോ.കെ.എസ്.അനില്‍കുമാറിന് തല്‍സ്ഥാനത്ത് തുടരാനാവുമോ? വിസി നല്‍കിയ സസ്പെന്‍ഷന്‍ ഉത്തരവ് സിന്‍ഡിക്കേറ്റ്  റദ്ദാക്കിയെങ്കിലും വിസി ഒപ്പിടാതെ ആ തീരുമാനത്തിന് സാധുത ഇല്ലെന്ന വാദം ശക്തമാണ്. വിസിയുടെ ചുമതലയുള്ള ഡോ. മോഹനന്‍കുന്നുമ്മലും താല്‍ക്കാലിക  വിസി ഡോ.സിസ തോമസും തങ്ങള്‍ക്കില്ലാത്ത അധികാരം ഉപയോഗിച്ച് ചെയ്ത സസ്പെന്‍ഷനും തുടര്‍ നടപടികളും  ഹൈക്കോടതി അംഗീകരിച്ചിട്ടില്ല എന്നാണ് മറുവാദം. റജിസ്ട്രാറുടെ സസ്പെന്‍ഷന്‍കോടതി അംഗീകരിച്ചില്ല, സിന്‍ഡിക്കേറ്റ് നടപടി റദ്ദാക്കിയില്ല എന്നീ വാദങ്ങളുയര്‍ത്തി സിന്‍ഡിക്കേറ്റെടുത്ത തീരുമാനം ശരിയാണെന്നാണ് ഭരണപക്ഷം വാദിക്കുന്നത്. 

എതായാലും സസ്പെന്‍ഷന്‍ വിഷയവും ഒപ്പം ജോയിന്‍റ് റജിസ്ട്രാര്‍ക്ക് ചാര്‍ജ് നല്‍കിയതും പിന്നീട് അത് റദ്ദാക്കി മറ്റൊരാള്‍ക്ക് ചാര്‍ജ് നല്‍കിയതുമെല്ലാം വീണ്ടും കോടതിക്ക് മുന്നിലെത്തും. ഇതിനിടെ ഗവര്‍ണരുടെ ഇടപെടലുണ്ടായാല്‍ അതും കോടതിയില്‍ ചോദ്യം ചെയ്യാന്‍ സിന്‍ഡിക്കേറ്റിലെ ഇടത് അംഗങ്ങളും സര്‍ക്കാരും  തയ്യാറായിരിക്കുകയുമാണ്.

There are counter-arguments that the High Court did not uphold the suspension initiated by VCs who allegedly exceeded their authority. The issue, including the interim appointments for the Registrar's charge, is expected to return to court, with the Syndicate and government prepared to challenge any potential intervention by the Governor.
